Terms of Service

1. Purpose

These terms of service (the "Terms") govern access to and use of the Labs66 platform (the "Service"), accessible at labs66.com, published by EMILIOO SAS.

By creating an account or using the Service, you accept these Terms in their entirety. If you do not accept these terms, you must not use the Service.

2. Publisher

The Service is published by EMILIOO SAS, a simplified joint-stock company with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 989 788 005. Registered office: 60 rue François Ier, 75008 Paris, France.

3. Service Description

Labs66 is an AI-augmented workspace designed for marketing teams and brands. It enables users to centralize brand knowledge and context, create strategic plans, organize documents, and interact with an AI copilot connected to their data.

The Service is provided "as is" and may evolve at any time. EMILIOO SAS reserves the right to modify, suspend or discontinue all or part of the Service at any time, with or without notice.

4. Registration and Account

Access to the Service requires creating an account. You are responsible for the confidentiality of your credentials and all activity under your account.

You agree to provide accurate and up-to-date information. EMILIOO SAS reserves the right to suspend or delete any account in case of non-compliance with these Terms.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent purposes or infringing on third-party rights
• Attempt unauthorized access to EMILIOO SAS systems or data, or those of other users
• Introduce viruses, malware or any malicious code
• Use the Service to generate content that is illegal, defamatory, discriminatory or violates privacy
• Resell, sublicense or commercially exploit the Service without prior written authorization

6. Artificial Intelligence and Third-Party Models

The Service integrates artificial intelligence features provided by third-party providers (including OpenAI, Google and Anthropic). These large language models (LLMs) are used to process user queries and generate contextualized responses.

EMILIOO SAS does not train any large language model (LLM).

Data transmitted to third-party AI models through the Service is subject to the terms of use and privacy policies of the relevant providers. EMILIOO SAS selects providers offering guarantees of non-use of data for model training purposes (business APIs), but cannot absolutely guarantee the practices of these third parties.

AI-generated content may contain errors, inaccuracies or outdated information. The user is solely responsible for verifying and using generated content. EMILIOO SAS does not guarantee the accuracy, completeness or relevance of AI responses.

7. User Data and Content

You retain all intellectual property rights over the data, documents and content you import or create in the Service ("User Content").

By using the Service, you grant EMILIOO SAS a limited, non-exclusive and revocable license to process your User Content solely for the purpose of providing the Service (display, storage, contextual AI processing).

EMILIOO SAS claims no ownership rights over your User Content and does not use it for any purpose other than providing the Service.

8. Intellectual Property

The Service, including its source code, interface, texts, design, logos and brand, is the exclusive property of EMILIOO SAS and is protected by intellectual property law.

Any unauthorized reproduction, representation or exploitation is prohibited.

9. Pricing and Subscriptions

The Service offers free and paid plans. Current prices are displayed on the Pricing page. EMILIOO SAS reserves the right to modify its prices at any time, subject to informing users within a reasonable timeframe.

Paid subscriptions are billed according to the chosen period (monthly or annual). Payments are non-refundable, unless required by law.

10. Limitation of Liability

The Service is provided "as is", without warranty of any kind. EMILIOO SAS does not guarantee that the Service will be available uninterrupted, error-free or secure.

To the extent permitted by law, EMILIOO SAS shall not be liable for any indirect damage, data loss, loss of revenue, lost profits or harm resulting from the use or inability to use the Service.

In particular, EMILIOO SAS shall not be liable for content generated by third-party AI models, nor for decisions made by the user based on such content.

11. Termination

You may terminate your account at any time from the Service settings. EMILIOO SAS reserves the right to suspend or terminate your account in case of violation of these Terms, without notice or compensation.

Upon termination, your data may be deleted in accordance with our privacy policy.

12. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, unless mandatory legal provisions provide otherwise.

13. Amendments

EMILIOO SAS reserves the right to modify these Terms at any time. Users will be informed of substantial changes. Continued use of the Service after notification constitutes acceptance of the modified Terms.
